Florida’s flood disclosure law: what every Broward landlord must know

If you rent out residential property in Broward County, a Florida law that took effect on October 1, 2025 (F.S. 83.512) changed what you’re required to tell your tenants – and a surprising number of owners still aren’t compliant.

What the law requires

Under SB 948, codified at Florida Statute 83.512, landlords must provide a written flood disclosure to residential tenants at or before the time a lease is signed.

Why this matters more in Broward than almost anywhere

Broward County is one of the most flood-exposed regions in the country. Large stretches of Hallandale Beach, Hollywood, Fort Lauderdale, Dania Beach, and Pompano Beach sit in or near designated flood zones.

The disclosure isn’t just paperwork – it’s a documented record that protects you as much as it informs the tenant.

What to actually do

  • Add the disclosure to every residential lease going forward, delivered at or before signing.
  • Know your flood history. If you’re aware the property has flooded or filed flood-related claims, disclose it.
  • Check your flood zone. FEMA’s flood map service center lets you look up any address.
  • Keep records. Retain a signed copy of the disclosure with the lease.
